The High Court in Accra has postponed its ruling on the lawsuit filed by Bernard Mornah, the flagbearer of the People’s National Convention (PNC), challenging his disqualification from the presidential race by the Electoral Commission (EC).

Mr Mornah is among 11 candidates who were disqualified due to errors in their nomination forms, which he claims were not adequately addressed by the EC.

In his lawsuit, Mr Mornah alleges that the EC violated constitutional provisions by failing to provide him with an opportunity to rectify the mistakes in his nomination documents.

He contends that the commission’s actions deprived him of his right to participate in the elections and that he should have been allowed to correct any errors before disqualification.

The EC, however, has countered Mr Mornah’s claims, stating that while they pointed out minor errors to the candidates, they did not highlight errors that were deemed criminal in nature.

This distinction is central to the commission's defense, as they argue that not all errors warrant an opportunity for correction, particularly those that could compromise the integrity of the electoral process.

During the court proceedings on Wednesday, October 16, Mr Mornah's legal team maintained that the EC had exceeded its discretionary powers in disqualifying him without allowing for corrections.

His lawyer, Harold Atuguba, emphasised that the commission's approach to the disqualifications was flawed and unjust.

After the hearing, Mr Atuguba urged the EC to suspend all electoral activities related to the presidential election until the court reaches a decision on the matter.
