The Bolgatanga High Court has acquitted and discharged a man who was sentenced for loitering during curfew hours in Bawku.
The man, Nashiru Ayambila was arrested last month and processed before court.
A Bolgatanga Circuit Court presided over by William Boampong sentenced him to three years in prison with hard labour.
He has however been freed following a successful appeal.
Providing a detailed account of the court proceedings, Joy FM’s Upper East regional correspondent Joseph Osei said the defence counsel argued that the earlier ruling was perverse because the law on which his client was jailed has been repealed.
Quoting the Public Order Law, the counsel argued his client should at best be fined or at worst be given a jail sentence not exceeding one year.
He described the Circuit Court's verdict as too harsh.
His client has subsequently been acquitted and discharged.
