The Supreme Court has thrown out a writ challenging the appointment of Otiko Afisa Djaba as Minister for Gender and social protection, describing it as "incompetent."
The court held it was unable to hear the case because one of the lawyers for the plaintiffs, Godwin Edudzi Tameklo did not possess a valid Solicitor's license at the time of issuing the writ.
Member of Parliament for Ashaiman constituency, Ernest Norgbey, and the Member of Parliament for the Juaboso Constituency, Kwabena Mintah Akandoh headed to the court in February this year challenging Madam Djaba’s appointment as Gender Minister.
They said the Minister could not occupy the position due to her failure to undertake the mandatory National Service.
Lawyers for the Minister led by Nutifafa Kuenyehia raised an objection when the matter was called today, Tuesday, December 12, 2017.
He said Mr Edudzi Tameklo lacked a valid license to practice at the time he issued the writ.
In his response, Mr Tameklo told the court he had applied for a renewal of the license and had not received it when he issued the writ.
But the Chief Justice, Sophia Akuffo, presiding judge on the case did not find that excuse worthy.
She asked, "Did you have a valid license at the time?"
Mr Tameklo replied, "No", resulting in the dismissal of the writ by a unanimous decision by the seven-member panel.
In the decision read by Justice Akuffo, the court explained it could not hear the matter because the lawyer did not have a license at the time of issuing the writ.
"The writ is hereby struck out as incompetent", she said.
