Three members of a family in Winneba have petitioned the Chief Justice, Justice G K Acquah to cause investigations into an interim injunction issued by a magistrate’s court at Winneba restraining them from participating in the funeral of a very close relative.
According to the three, the plaintiff Nana Otubua Siripi II, Tufuhene of Winneba, was only using the court for his own selfish end to prevent certain key members of the family including his own brother and uncle from participating in the burial and funeral of his late mother Madam Adeline Deheer Hammond so that he will not be held accountable to the family over the cost.
John Kow Otabil, uncle, Emmanuel Donkor, Inspector of Police and brother, and Ayi Mensah, head of family all claimed that the court hurriedly issued the injunction upon an affidavit by Nana Siripi in support of an ex-parte motion without hearing their side of the story.
The petitioners said the injunction was issued on January 30, only three days before the funeral and burial after their long involvement in the planning denying them the opportunity to participate in the burial and the funeral which had already been held.
The court also issued an order for the handing over of some foreign money sent by Hannah Hammond Donkoh, a relative living outside the country towards the funeral expenses to the plaintiff.Source: GNA
