A US based Ghanaian professor has described as a “sham” a Proposed Legal Profession Regulation 2017 which is currently before Parliament and which would legalize the quota system and the entrance examination.

Prof Stephen Kwaku Asare said the Regulation which will mature in 21 days, will be an affront to a transparent, incorruptible, automatic admission requirement process and will rather perpetrate a subjective, regressive admission process into the Ghana School of Law.

In an open letter to Parliament, a copy of which has been intercepted by Myjoyonline.com, the sole crusader for the abolishment of quota system and entrance exams into the Law School accused the General Legal Council (GLC) of trying to entrench its power at the detriment of a better legal education.

Checks by Myjoyonline.com indicate that Parliament has begun considering the Regulation with the Committee on Subsidiary Legislation meeting to discuss its content on November 28, 2017.

In attendance were Mr Yaw Buaben Asamoa, Mr Shaibu Mahama, Dr Mark Kurt Nawaane, Mr Stephen Ackah and Mr Kwabena Minta Akandoh.

Prof Asare, popularly referred to as Kwaku Azar, without mincing words accused the General Legal Council, the body that superintends over Ghana’s Legal profession of secretly drafting a "fatally flawed and self-aggrandizing" Regulation, in a hope of getting Parliament to regularize what is clearly an archaic entry procedures into the Ghana School of Law.

“In today's world of distance learning and assorted electronic learning platforms, it is entirely unnecessary for students to converge at a centralized location or any central locations to study evidence, procedure, taxation, legal accountancy, interpretation, alternative dispute resolutions, conveyancing, family, company, labor, banking and insurance law. The Ghana School of Law has no comparative advantage in teaching these courses. Nor are these courses so unique that they cannot be taught at the 10 Law Faculties,” he stated.

He said the regulation which is currently before Parliament is “dead at birth” and urged parliamentarians not to give it a new lease of life.

Kwaku Azar only recently secured a landmark ruling from the Supreme Court which described the admission process into the Ghana Law School as illegal.
