The Energy Commission and the Millennium Development Authority (MiDA) have been dragged to court and accused of fraud in the transaction for the handing over of the Electricity Company of Ghana (ECG) to a private concessionaire.
This comes days after workers of the power distribution company had held protests over the decision to have ECG privatized.
A member of the Truth & Accountability Forum Saka Salia is demanding a halt to the process citing breaches to existing laws.
He said the Public Utility and Regulatory Commission (PURC) has written a letter to the effect of breaches and the agreement shows an impersonation of the Energy Commission.
The Energy Commission, which is the body mandated to give licenses to people engaged in the energy sector, Mr Salia said, are not aware that even their letterheads were being used in the deal.
He told Kyenkyenhene on JOYNEWS’ AM Show on the MultiTV that the Energy Commission is not part of the Committee working on the transaction.
“These people go and sit alone and do their tariff methodology and everything and emboss their documents with the Energy Commission on it, purporting that the documents are coming from the Commission when the Commission does not know anything about it,” he said.
“We have uncovered all these things…if Energy Commission can all of a sudden become law unto itself and allow people to flout the law with impunity and then you sit down unconcerned, even though your attention has been drawn to it,” he added.
He said the police have not contacted the Forum, explaining the Forum’s reason for going to court to annul whatever agreement there is the forgery.
Mr Salia argued that if someone uses a false document to transact business the transaction is null and void.
“To the extent that those forged documents are still in the system the transaction should not be made to stand,” he said.
The Forum is pleading the court among others for:
1. A declaration that all transactions and processes touching and concerning said concessionary agreement for ECG using said tariff methodology documents are null and void
2. A declaration that all transactions and processes touching and concerning said concessionary agreement for ECG using said electricity distribution and sale license documents are null and void.
