The Executive Council of the Ghana Independent Broadcasters Association (GIBA) is threatening legal action against the Food and Drugs Board over the ban on advertisements of alcoholic beverages.
The GIBA says if the FDB fails to lift the ban on advertisement of strong liquors by Friday it would go to court.
The association has complained that the FDB’s temporary ban on the advertisement of strong liquors, specifically spirits and bitters, is arbitrary.
But the FDB argues that its position is backed by section 32 of the FDB law which grants it powers to suspend such adverts.
But the Executive Secretary of the GIBA, Mr. Gerald Ankrah says the board does not have the mandate to impose such suspensions on any alcoholic beverage.
He argues that the FDB’s mandate is limited to the prohibition of advertisements on drugs, cosmetics, or chemical substances that are being put out as treatment, preventive medicine or cure for a disease.
He said alcoholic beverages that are advertised by private broadcast houses are excluded.
