The controversial CI 78 which will create 45 new constituencies has taken a new twist with the Majority in Parliament calling for the rejection of the report of the Committee on Subsidiary Legislation.
The CI 78 was laid in Parliament on Tuesday September 4, 2012 in line with Article 11 (7) of the constitution and was referred to the committee on Subsidiary Legislation for deliberation.
The committee after its deliberations presented a report which was laid in Parliament, Friday.
The committee recommended the annulment of the Representation of the People (Parliamentary Constituencies) Instrument 2012 (C.I 78)
According to the committee which is made up of both members of the Minority and Majority in Parliament, the CI 78 is still riddled with mistakes and must be withdrawn.
The report of the committee stated “some existing electoral areas are excluded from the constitutional Instrument while non-existent electoral areas have been established by the C.I 78. Even though the committee has found the errors in the CI 78, it is unable to effect the necessary corrections. Effecting the changes in the Constitutional Instrument would amount to amending the Instrument which is not permitted under the law.”
The committee further stated, “it is only the Sponsor, that is the Electoral Commission that can effect the changes by withdrawing the Instrument, making the corrections and laying it again in Parliament per the decision of the Supreme Court.”
The recommendation for the withdrawal of the CI 78 was taken by a majority decision.
But the Majority in Parliament is unimpressed with the recommendations of the committee report.
Shortly after it was laid by the chairman of the Subsidiary Legislation, Kwame Osei Prempeh on Friday, the Majority in Parliament is calling for the report to be rejected.
Adom News’ Listowel Fodjour who was in Parliament reported the debate will be moved and the report of the committee adopted or rejected next week Monday.
