The much anticipated ruling by the Supreme Court over the eligibility or otherwise of the International Finance Corporation to give evidence in the trial of Tsatsu Tsikata could not come off on Wednesday.
The ex-Ghana National Petroleum Corporation CEO, convicted already by the Fast Track High Court for wilfully causing financial loss to the State ahead of his appeal against the court’s refusal to compel the IFC to give evidence on grounds of immunity, arrested the Supreme Court’s ruling pending his petition against Justice Henrietta Abban, the trial judge he accuses of bias and “desecrating justice.”
Tsatsu on Wednesday filed a motion to invoke the supervisory jurisdiction of the Supreme Court to quash the decision of Henrietta Abban. He wants Justice Abban’s guilty verdict and subsequent five-year-jail term scrapped to enable the Supreme Court rule on his appeal for the IFC to be brought to court to give evidence in his favour.
In a brief address, Tsatsu indicated that Justice Abban’s verdict ahead of the Supreme Court’s pronouncement amounted to undermining its authority and should not be allowed to stand.
His appeal before the Supreme Court, he said, is to determine if there was any merit in his submission and it was untenable for the Fast Track High Court to side-step it and proceed to pronounce judgement.
The Supreme Court therefore adjourned indefinitely to enable Tsatsu complete his processes in seeking to quash the Justice Abban judgement.
Tsatsu was found guilty of three counts of wilfully causing financial loss to the State and another count of misapplying state property, and was subsequently sentenced to five years on each count. The sentences are to run concurrently.
