The National Women's Organizer of the New Patriotic Party (NPP), Otiko Afisa Djaba said the nine-member panel judges who adjudicated the presidential election petition should be held in “contempt” [of court] for giving a ruling that violated constitutional provisions. According to her, the full details of the judges’ ruling showed that they upheld obvious electoral breaches such as electoral officers not signing results, which violated Article 49 of the 1992 Constitution. Otiko Djaba was speaking Monday on Adom FM’s “Dwaso Nsem” morning show with Captain Smart. She said the public looks up to the Judiciary to interpret the constitution, so when they [the judiciary] commit such obvious constitutional violation and create confusion in the law, it becomes difficult for the public to trust in the judiciary. Otiko Djaba noted that it doesn’t make sense for the judiciary in a developing country like Ghana to create such confusion about the constitution after 56 years of independence. “It is confusing because the judgment given by the Supreme Court judges is obviously at variance with the 1992 Constitution,” she contended. Otiko Djaba recalled that the Electoral Commission (EC) disqualified Ghana’s former first lady, Nana Konadu Agyeman Rawlings of National Democratic Party (NDP) from contesting in the 2012 presidential elections because she failed to provide the full complement of signatures on a nomination forms but the Supreme Court’s ruling implies that the same rule does not apply before the EC declared the election results. “I find it weird that the judges overlooked the fact that the electoral officers did not sign the results before they were declared - why do we sign on cheques if signatures are not that important as the Supreme Court wants to tell us?” she asked.
