A fast track high court in Accra has adjourned the case in which the Member of Parliament for Ellembele, Mr Freddie Blay is challenging executives of the CPP to nullify his election as the party’s Parliamentary Candidate for the December polls.
After hearing submissions from both sides , the court presided over by Justice Edward Amoako Asante adjourned the case to December 6, 2008.
Lawyers for the CPP said they had to appear in court at very short notice and asked for more time to enable the defence file an appropriate response.
The Central Committee of the Convention People’s Party in August nullified the parliamentary primary in the Ellembele constituency which elected Freddy Blay as the party’s parliamentary candidate for the constituency.
Although the committee did not assign any reason for its decision, reports were rife that Mr Freddy Blay was given the hit for allegedly endorsing New Patriotic Party presidential candidate, Nana Akufo-Addo.
Mr Blay is also said to have suggested that his party forgets about winning the presidency and rather focus on winning more parliamentary seats.
Freddy Blay who is the First Deputy Speaker of Parliament contests the seat for the fourth time on the ticket of the CPP.
However in a 29 August interview with Joy News, the General Secretary of the CPP, Mr Ivor Greenstreet said the party does not recognise Mr. Blays re-election.
“What this exactly means is that the results of the parliamentary primaries which elected Mr Freddy Blay are null and void,” he stated.
He added, “In accordance with that the Central Committee also wishes to make it clear that until the Central Committee approves of elected parliamentary candidates they cannot file with the Electoral Commission on the ticket of the Convention People’s Party.”
Although the party has called for an out-of-court settlement of the matter, Mr Freddy Blay prefers to seek justice at the law courts.
The party has just three representatives in the legislature.
