The Assin North MP, Joe Gyaakye Quayson, has written to the Chief Justice to prevail on the Judge sitting on his case to recuse himself.

The MP says, the judge, Justice Kwasi Boakye is alleged to have made comments prejudicial to the case.

According to him, Justice Kwasi Boakye had said that the appropriate time Article 94(2) of the 1992 Constitution kicks in is during the filing of the nomination by an MP.

This allegation was dismissed by the judge when it was made because the alleger, Abraham Amaliba, failed to show any evidence that Justice Kwasi Boakye indeed made the comment on the 12th of April.

In court on Tuesday, June 1, Abraham Amaliba reminded the court, once he’s written to withdraw from the case, it means he’s no longer a party to the matter and that the MP, as processes of court demands, ought to be served and notified for him to get a legal representation in court.

The court thus ordered Abraham Amaliba to facilitate the service of the MP so the court processes could continue.

Present in court were the NDC National Chairman, Samuel Ofosu Ampofo and National Communication Officer of the party, Sammy Gyamfi.

Sammy Gyamfi addressed the media saying they have petitioned the Chief justice to prevail on the judge to recuse himself from the case because he has been purported to have made comments prejudicial to the trial.

Sammy Gyamfi says, there would be a real likelihood of bias should the judge be made to sit on case he has predetermined.

The Representative of the petitioner, Richard Tachie-Mensah says the NDC just wants to muddy the waters and create situations where there aren’t any.

According to him, the allegation mounted on the Judge is untrue adding that the accusation is a ploy to delay the case.

The case, has been adjourned to the June 8 when the MP, Joe Gyaakye Quayson would have been served and would have found a legal representation.

In January this year, the Cape Coast High Court placed an interlocutory injunction on the swearing-in of James Gyakye Quayson as Member of Parliament for Assin North upon winning the 2020 Parliamentary election in the constituency.

The court also placed an injunction on Mr Quayson from holding himself as the MP-Elect for the constituency.

This followed an application by one Michael Ankomah , challenging the eligibility of Mr Quayson as he was a citizen of Canada when he filed his nomination to contest as a Member of Parliament (MP) in Ghana.
