A legal expert is urging pharmaceutical giant Kinapharma to go ahead and sue the police for its seizure of some chemicals from the company’s warehouse.
Yoni Kulendi says legal action against the police would send strong signals to officers to act more professionally.
Mr Kulendi’s comment follows a raid by the police on the company’s Spintex warehouse on suspicion that the company had in its custody substances suspected to be cocaine.
Test however proved that no such substances were present.
Kinapharma has demanded an apology from the police and has even threatened legal action against the police and media houses it accuses of tarnishing its image.
Speaking on Joy FM’s news analysis programme Front Page, Mr Kulendi suggested legal action would be a good step to take.
“There is a tendency for people to do mischief; there is a tendency for people even to use the law to hurt others,” Mr Kulendi said, urging the pharmaceutical company to “do it (sue) and do it with resolve because they’ll not just be fighting a battle for Kinapharma but they’ll be fighting for the silent majority of Ghanaians who have suffered such arbitrariness, sometimes utter unreasonableness.”
“Those who think that they can continue to hide under the cloak of public office and perpetuate either deliberate malice, mischief, or be reckless with indifference to hide their conduct affect other people, they’re living in a dream,” he said.
Mr. Kulendi also expressed dismay at the apparent ignorance of the police on how the pharmaceutical industry works leading to the misinterpretation of standard procedures.
“You don’t even need to be a narcotic detective to understand that in the kind of facility that they operate [with] very restricted substances, the environment is itself controlled and that is why they have all the kinds of precautions....balances and counter-checks,” he said.
“If the men and women trained to detect who is possessing what lack this elementary awareness then we are in trouble.”
Although Kinapharma says it could sue the police and some media houses and presenters, it is not known when it would carry through with its threat.
