The National Labour Law mandates employers to insure their workers against injuries and occupational hazards.
But the Workmen’s Compensation Law or Employer’s Liability Policy is not being adhered to, according to insurance companies.
The Law holds employers liable, subject to the provisions thereof, for personal injury sustained by a workman by accident arising out of and in the course of his or her employment.
The policy is open to all workers, but mostly applicable to jobs with high risk exposure – including the mining, timber, construction and manufacturing sectors.
Ashanti Regional Manager of the International Energy Insurance (IEI) Company Limited, Isaac Baidoo, tells Luv Fm the statutory requirement that guarantees compensation for those injured in the course of employment is being flouted by most businesses.
“Every employer is supposed to have this kind of policy in place because you wouldn’t know when accident of this nature can occur to take the life of your employee, and if you don’t have such a policy in place, you’d end up incurring huge legal cost… so it’s always advisable to take this employers liability”, he stated.
Mr. Baidoo emphasized the need for employees to engage management in negotiations to put in the necessary insurance covers as part of their employment benefits.
He spoke to Luv FM after presenting a Gh¢35,000.00 cheque in insurance claims to three employees of the Ghana Nuts Limited in Techiman, who were involved in an accident.
Meanwhile, Mr. Baidoo says IEI is performing creditably well, barley three years after venturing the Ghanaian market, stating that “our branches in Tema, Takoradi and Accra are making inroads in giving several covers for most of the oil players or companies”.
