The Attorney-General has moved to block a fresh attempt by suspended Chief Justice Gertrude Torkornoo to stop one of the three petitions calling for her removal from office.
The latest legal battle stems from a June 23, 2025 judicial review application in which the suspended Chief Justice asked the High Court to strike out a petition filed by a group known as the Shining Stars of Ghana.
Her legal team argued the petition was fundamentally flawed because the group is not registered and its members remain anonymous.
But the Attorney-General, through Deputy Attorney-General Dr Justice Srem-Sai, insists these claims are without merit. In documents filed at the High Court, State Attorney Reginald Nii Odoi asserted that “a body of persons, whether named or not named and, if named, by whichever name, needs not be incorporated or registered to exist at law.”
The AG’s office wants the entire motion thrown out, arguing that the issues raised in the application fall directly under the proceedings of the Article 146 committee, a constitutionally mandated process conducted in camera, not in open court.
This marks Justice Torkornoo’s second attempt to use the High Court’s powers of judicial review to halt the process.
Her earlier application sought to strike out all three petitions and stop the Justice Pawmang Committee’s sittings over alleged breaches of natural justice. That effort failed when the High Court dismissed it on the grounds of abuse of process and lack of jurisdiction.
While an interpretation case on the matter is still before the Supreme Court, an injunction request linked to that case was also rejected, clearing the way for the Article 146 proceedings to continue.
