The panel of judges hearing the Presidential Election Petition returns after almost two weeks break to give their final directions ahead of the much anticipated verdict.
The Petitioners and Respondents, minus the NDC filed their addresses yesterday to meet the July 30 deadline issued by the judges.
The NDC intends to file their address later this morning but will have to give a cogent reason why they were unable to meet the deadline.
Myjoyonline.com will give you live updates on the proceedings in court.
Proceedings Begin
Tsatsu Tsikata admits to late filing of their addresses. He says they needed to attach ten appendices to their addresses and that was the reason for the delay.
Philip Addison objects. He says court orders are meant to be obeyed. He says when the third respondent realised that they could not file on the deadline all they could do was to make a formal application for a late filing of the address. He says looking into their eyes they have had no sleep at all. They have looked at the address by the Petitioners to fine tune their address. It is a communist inferior tactics. They are now coming after the event with an oral application and that is unacceptable. He leaves it entirely to the court to take a decision.
Tony Lithur jabs Addison. He describes the comment as a "desperate suggestion." He says he over slept.
Tsikata says he had a long sleep last night. He adds that he has not seen the addresses filed by the Petitioners. Even though the comment from Addsion was meant for a joke, it is quite offensive, he adds.
The judges take serious exception to the conduct of Tsikata.
Rulings
Presiding Judge, William Atuguba says the act that caused the delay in the deadline was for the benefit of this court but says the counsel, as a senior lawyer should have been guided by the practices of the court and ought to have sought formal application for late filing. Court orders must be obeyed, Atuguba stresses. He adds that given the magnitude of the case and the fact that the address was filed on the morning after the deadline they have had to reluctantly admit the address, albeit the late filing.
Tsatsu Tsikata applies for a brief oral summation of their addresses. Atuguba intervenes. He says that is the direction the court intends to give.
He then states that proceedings have been adjourned to August 7 for the parties to give oral addresses.
Addison asks for directions on the time frame to be allotted for the oral addresses.
Atuguba says 30 minutes should be enough. Tsatsu Tsikata draws the court's attention to the possibility of the adjourned date coinciding with the Ramadan holiday and because the date for Ramadan.
Atuguba says if the Ramadan falls on August 7 the adjourned date will be postponed to the following day.
