The docket on the four persons, including two policemen, alleged to have attempted to sell 50 pieces of pump action rifles on the open market in Accra has been forwarded to the office of the Attorney-General, the prosecutor in the case, ASP George Abavel­im, told the Accra circuit court Tuesday, adding that he was mindful of the jurisdic­tion of the court in the matter. Mrs Ivy Heward-Mills, the judge, told the parties that she was aware the matter had been transferred to another court because she did not have jurisdiction to hear the case unless she was given specific directives by the Chief Justice. According to her, the matter was among several others for which specialised courts had been designated to handle. However, counsel for two of the accused persons, Mr Addo Atuah and Mr Addae Aboagye, prayed the court to admit the accused persons to bail in view of the new development because their human rights were involved, while the offence was not among those for which bail should be refused. The prosecutor told the court to stand the case down to enable the investigator to go to the Chief Justice's secretariat to find out the court where the matter had been transferred. Later, it was learnt that the matter had been referred to Circuit Court One, but the matter had to be transferred to the office of the A-G. For that reason, the matter was adjourned to June 29, 2009. But Mr Atuah hinted the Daily Graphic that he would apply for a habeas corpus for the release of the accused persons. The accused persons - Inspector Simon Amedekanya of the Tesano Police Station, Corporal Doris Oppong Asante of the Arms and Ammunition Section of the Tesano Divi­sional Headquarters, Isaac Siada, a trader, and Kwabena Amoah, a driver - are facing provi­sional charges of possession of firearms without authority. Their pleas have not been taken. The facts of the case, as presented by the prosecution, are that Siada is a dealer in spare parts, while Amoah is the personal driver of Inspector Oppong of the Arms and Ammuni­tion Section of the Nima Police Station. According to the prosecution, the Bureau of National Investigations (BNI) received intelligence reports on June 12, 2009 that some people were engaged in the illegal sale of firearms near the Achimota Overhead Bridge and dispatched men to the scene. It said the accused persons were arrested with the guns packed in boxes and investiga­tions revealed that on June 11,2009, one Obiri Yeboah, a friend of Siada's, had called Siada on telephone to say that a certain Alhaji want­ed some guns to purchase. As a result, Siada was said to have contact­ed Inspector Amedekanya for assistance to arrange for the guns and the Inspector also contacted Corporal Asante. According to the prosecution, Corporal Asante also contacted Inspector Oppong, who supplied the 50 pieces of guns after which she, together with Amoah, was assigned to carry them in Inspector Oppong's Opel Vectra to the point of sale to meet the said Alhaji for inspection and payment.
