The Supreme Court is expected to later today - Tuesday July 14, 2015 - hear the case questioning the procedure for the appointment of the Electoral Commissioner.
The plaintiff, Citi FM’s Richard Dela Sky is asking the Court to rule that the Council of State has the ultimate responsibility of appointing Chairman of the election regulatory body.
The appointment of a new EC boss generated a lot of controversy before President John Mahama selected Charlotte Osei.
Lawyer for the plaintiff, Alexander Afenyo Markin, says he believes the highest court will take notice of the President’s action.
“I don’t think this will make the matter moot in anyway, I believe that the judges will take judicial notice and make appropriate pronouncements”, Mr Markin told Joy News.
He cited the Abu Ramadan case where the EC went on to open registration for the District Assembly elections although a case to halt the process was in court.
“When a matter is before the court for determination, it will amount to contempt if you still proceed”, he added.
