The Ahafo-Ano North District Chief Executive, Mr. Eric Nana Agyemang-Prempeh, is facing contempt of court proceedings brought against him by the Progressive Transport Owners' Association (PROTOA).
This follows his alleged obstruction of the course of justice, show of disrespect and disregard for the authority and administration of the law, and prejudicing a suit between the PROTOA and the Paramount Chief of Tepa Traditional Area, Nana Adusei Atwenewaa Ampem II before a Kumasi High Court.
Mr. James Agalga, counsel for the applicant, called for the respondent, the DCE to be committed, convicted, and sentenced in order to purge him of the contempt.
Both the respondent and his counsel were absent in court and the presiding judge, Justice Imoru Ziblim accordingly fixed July 12,2007 to decide the fate of Nana Agyemang-Prempeh.
In a submission, counsel for the applicant argued that somewhere in December last year the applicant, which is a public transport service provider, applied for a permit to operate from a designated loading point at the Tepa main lorry station near the market which was granted by the District Assembly.
Soon after, the plaintiff/applicant erected a wooden structure (kiosk) as office apartment to be used as offices in front of its loading point and commenced business at the lorry station, but was met with stiff opposition from a rival group, the Ghana Private Road Transport Union (GPRTU) which often resulted in violent clashes.
The counsel continued that the GPRTU lodged a complaint before the Traditional Council upon which the plaintiff/applicant was invited for settlement of the impasse.
He asserted that at one of the sittings of the Tepa Traditional Council (TIC) together with the feuding parties, the Omanhene, who is the President of the TIC, ordered his client, PROTOA to remove its office apartment from the space assigned to it by the Assembly.
Mr. Agalga said in furtherance that, the TIC then hired some thugs who caused the removal of the applicant's kiosk after it had refused to comply with the “unlawful order of the Council.”
According to him, a day after the exercise by ¬the said thugs, his client found the kiosk completely burnt on May 8, 2006.
