An Accra High Court has been asked to strike out the charge of assault levelled against NDC National Chairman, Samuel Ofosu Ampofo, accused of conspiracy to cause harm and assault on a public officer.
Lead counsel Tony Lithur on Monday argued that it was important for the court to first rule on this application before the case progresses.
Mr Ampofo was dragged to the court following the leak of an audio which state prosecutors allege to be a plot by the NDC leader to commit various crimes.
Another officer of the party Kwaku Boahen is also before the court but his lawyers maintain he wasn’t present during the said meeting.
His lawyers led by Dr Abdul Baasit Bamba have filed an application demanding that state prosecutors make available some documents they have failed to disclose.
JOYNEWS is learning this relates to a diary of action which spells out the steps taken by a police investigator right from when a complaint is made to the conclusion of investigations.
Director of Public Prosecution Yvonne Attakora Obuobisa said the state was opposed to this application.
She also revealed an investigative report relating to the whereabouts of Mr Boahen on the date the meeting is said to have taken place has been filed at the court’s registry.
Justice Samuel Asiedu adjourned the case to June 7 for lawyers argue the pending applications.
