A member of the ruling National Democratic Congress (NDC), Yaw Osei Gyamfi has filed a suit to scuttle Kofi Adams’ ambition of becoming the National Organiser of the party.

The plaintiff is challenging the NDC Deputy General Secretary’s qualification to run for office in Saturday’s national executive congress of the party.

The NDC suspended Kofi Adams in 2012 after a voice suspected to be his, was heard on a leaked tape saying he will do everything possible to prevent the late President Mills from securing the mandate of Ghanaians for a second term.

The plaintiff says Kofi Adam’s suspension disqualifies him from holding any office in the party.

Lawyer for the plaintiff, Bright Obeng Manu told Joy FM’s Top Story, Kofi Adams is not qualified by the party’s own constitution to hold the national executive position due to his suspension.

The application is to restrain his candidature, he confirmed.

He noted that petitions written by his client to the party to evoke its power to disqualify Kofi Adams did not yield any positive response. Rather, he claimed there have been attempts to frustrate him for attempting to ensure that provisions of the party are respected and implemented.

The plaintiff is also seeking interpretation of some provisions of the party.

According to the plaintiff, he has evidence to confirm that Mr. Adams acted in ways that violated the party’s constitution.

But Kofi Adams is adamant that those seeking to disqualify him will fail. He was certain the plaintiff has no evidence “unless they are going to cook it up themselves”.

He confirmed that the party has received the suit and its lawyers are working on it. The suit was therefore described by him as the “ joke of the century”.

He vehemently denied the suspension or punishment claims. He said he was only asked to “step aside” for an investigation and was reinstated with full benefits.

Mr. Adams further stated that the party has even entered into an arrangement with him in paying him all allowances that were due him when he was made to put his duty on hold.

The suit is emanating from somewhere in Sunyani, he claimed but fell short of mentioning names.

He pointed out contradictions in the suit as he wondered why he would be allowed to serve as Deputy General Secretary if he was not qualified for a national executive office.

Unwavering, Kofi Adams said he is “very clear of victory come Saturday”.

Hearing of the case will continue tomorrow, Tuesday December 16.

Joy News’ Afreh Kwakye Nuamah who was in court today when the case was called, said the plaintiff warned there would be a greater loss to the party if it goes ahead with the election and in an “unlikely” event that Mr. Adams wins.

The party would have to reorganize the national organizer position as the case is likely to go his way, he explained.

In an event that he loses the suit, the plaintiff said he is willing to compensate the party and Kofi Adams.
