The Wills Act, 1971 (Act 360) provides an individual above the age of 18 the opportunity to have a legal declaration of his or her wishes regarding the disposal of owned properties after death.
A will is regarded as void if it is not in writing and signed by the testator or by any other person at the direction of the testator. Also, by law, a person suffering from insanity does not have the capacity to make a will.
According to the Intestate Succession Law, 1985 (PNDCL 111) a person shall be deemed to have died intestate if at the time of death had not made a will. At this stage, the spouse or child or both shall be entitled absolutely to the household chattels of the intestate, Section 3 of the law says.
Today on The Law, host Samson Lardy Anyenini and his guest, Head of Paintsil, Paintsil & Co, Kweku Paintsil highlighted the significance of making a will before death and the required processes to be followed.
