The Constitution Review Committee has proposed a limit on the size of the Supreme Court, recommending that the Chief Justice and no more than 14 other justices should sit on the country’s highest court.
The Committee said the proposal is part of broader reforms to streamline the Supreme Court’s appellate jurisdiction, reduce its workload and improve efficiency in the delivery of justice.
To give legal effect to the recommendation, the Committee has called for an amendment to Article 128(1) of the 1992 Constitution to formally set an upper limit on the number of Supreme Court justices.
According to the Committee, fixing a maximum number would maintain flexibility in judicial appointments while preventing the court from expanding excessively.
However, the Committee advised against imposing numerical caps on the Court of Appeal and the High Court.
It argued that flexibility in the size of these courts is necessary to respond to population growth, increasing caseloads and the changing demands of justice administration.
The proposals form part of the Committee’s wider constitutional reform recommendations, which are expected to be considered by government as part of ongoing efforts to strengthen Ghana’s judicial system and democratic governance.
