The Court of Appeal has thrown out the stay of execution application of 'derobed' Bawku Central legislator, Adamu Dramani.
The MP had applied to the Court of Appeal to stay the execution of a High Court decision that threw him out of parliament and rendered his seat vacant following a challenge to his nationality by a constituent.
On Monday when the appeal was called he and his lawyers were absent.
While one of the MP’s lawyers Yoni Kulendi is reported unwell, the other lawyer, Egbert Faibille was reported to have been engaged at the Ghana@50 probe sittings as representing another client, Mr. Kwadwo Mpiani, former Chief of Staff.
But lawyers for cattle farmer Sumaila Bielbiel who initiated the case against the Bawku Central MP argue that Mr Dramani’s lawyers are deliberately seeking to delay the case.
The Court of Appeal upheld their arguments and awarded a cost of GH¢500 against Mr Dramani.
Speaking to Joy News shortly after the ruling, Mr Bielbiel told Joy News the penalty should have been higher.
“I was thinking that the judges would have awarded a cost of… GH¢5000 because these people, they have nothing to file, they have no defence that’s why their wasting our time,” Mr Bielbiel said.
Meanwhile Mr Dramani has been served with a notice of summons to appear before an Accra High Court on Thursday for a final determination of the appeal he filed against the decision against him.
He and his lawyers have contended that the decision, handed in default of Dramani filing defence processes, should pave the way for actual hearing of the suit.
