Lawyers for the ten alleged killers of the late over-lord of Dagbon Ya-Na Yakubu Andani are back in court seeking to over turn a circuit court decision which put their clients on remand. Lead counsel and New Patriotic Party MP for Akyem Abuakwa South, Atta Akyea told Joy News’ Dzifa Bampoh the human rights of his clients cannot be violated on the altar of a “fishing expedition” by the Director of Public Prosecutions (DPP). The ten accused persons were remanded in court to reappear on May 5, 2010, but Atta Akyea maintains the decision was perverse and cannot stand. On Monday, he filed a suit at the Human Rights High Court geared towards a possible reversion of the earlier decision. The court is expected to sit on Friday, but even before the case will be formally heard, the defence counsel said the arguments by the prosecution for his clients to be remanded whilst they investigate the allegations of murder were unacceptable and “quite funny”. “How do you investigate at the expense of the liberties of the individuals? That is very serious,” he charged, adding, that “under no circumstances should any Ghanaian be used for this kind of vain experimentation.” According to him the prosecution must prove to the court that indeed the accused persons if released will interfere in investigations, something he says the DPP has failed to well articulate. His understanding is that his clients have been residents in Yendi for well over eight years after the gruesome murder of the Ya-Na and have not in any way interfered in investigations by the state. He expects to put before the high court judge solid reasons why he thinks his clients do not deserve to be in detention. A Deputy Information Minister, Samuel Okudzeto Ablakwa declined to comment on the matter when Joy News attempted to solicit government’s position on the matter. Meanwhile, the Abudu family has filed a writ at a Kumasi Circuit Court against the Andani family, the regent of Dagbon as well as the Attorney General, accusing them of breaching the peace agreements brokered by the committee of three eminent chiefs. The writ was filed by Nana Obiri Boahene former Minister of State at the Interior Ministry. But the spokesperson of the Andani gate has described the writ as uneccessary. Andani Maham, told Joy News' Sammy Darko the writ is "unwarranted."
