The GFA Appeals Committee has dismissed Hearts of Oak’s review application against its ruling delivered on 20th October, 2015 in the case against Kumasi Asante Kotoko SC.
Below is the full decision:
PANELISTS
1. EMMANUEL ANNAN – CHAIRMAN
2. ALHAJI FAROUCK SEIDU – VICE CHAIRMAN
3. OWUSU ANSAH AWERE – MEMBER
4. CLAUDE OPPON – MEMBER
5. DIVINE SUNU – MEMBER
6. KWAME TAKYI – MEMBER
7. BAFFOUR AKOTO – MEMBER
8. DANIEL ODURO – SECRETARY
This application for review is at the instance of Accra Hearts of Oak Sporting Club Limited. The Appeals Committee on the 20th day of October, 2015 ruled on an appeal filed by Kumasi Asante Kotoko Sporting Sporting Club and overturned the decision of the Disciplinary Committee which was in favour of Accra Hearts of Oak. It is this decision that Hearts of Oak were not happy with which provoked this application for review.
Article 13(a) of the General Regulations states: “The decision of the Appeals Committee in any matter shall be final provided that the Appeals Committee shall have power to review its own decision either suo moto or an application by an aggrieved club, official or player”. This application is therefore well placed, however, we wish to reiterate that but for exceptional circumstances the Appeals Committee will not review its own decision. It is therefore sad to say that the issues raised in this application for review are by and large a rehash of issues already addressed by the Appeals Committee in the appeal filed by Kumasi Asante Kotoko S/C and no useful purpose will be served in repeating same.
We have found no exceptional circumstances that will justify a review of our decision dated 20/10/15 so therefore the application for review lacks merit and is hereby dismissed.
