Assin North MP, Joe Gyaakye Quayson, has cited the petitioner in his case for contempt.
He says Michael Ankomah Nimfah lied before the court of Appeal when he deposed to an affidavit that the issue of the interpretation of Article 94(2a)- the qualification of an MP- did not arise at the trial court in Cape Coast.
Tsatsu Tsikata contends that Article 94 (2a) talks about the qualification to be an MP was a major subject at the trial court and that it would be a lie for anybody to say that, that matter did not arise.
However, the petitioner, Michael Ankomah, insists the matter of the interpretation of Article 94 (2a) was not a subject matter at the trial court.
The panel of judges at the Court of Appeal adjourned their decision on the matter of contempt to March 22, 2022.
The second issue about the Application for a stay of execution was also adjourned to March 22, 2022. It was argued that some applications before the Supreme Court have a bearing on the case at hand.
The final issue before the court was the issuance of a certificate of non-compliance at the court of Appeal.
The MP and his lawyers are alleged to have failed to file their written submission within a stipulated period during the appeal application processes.
The third issue was also adjourned to March 22, 2022.
The High Court in July 2021 annulled the Parliamentary elections in the Assin North Constituency after it found Mr Quayson as not eligible to contest the polls.
Mr Quayson has since been legally fighting to set this aside, with the matter currently pending at the Court of Appeal.
A resident of the constituency Michael Ankomah Nimfah who initiated the action against the MP at the High Court has sought the intervention of the Supreme Court to stop the MP from performing Parliamentary duties.
