Constable George Kwakye of the Dansoman Police Station who shot and killed Joe Gabienu at Amasaman in November last year, is to appear in court to answer charges of manslaughter.The prosecution of Constable Kwakye is on the advice of the Attorney General and Minister of Justice, who directed that the constable be charged with the offence.In the A-G’s opinion, in his bid to arrest the deceased, the constable should have acted with caution, since at close range if he had intended to hit the deceased legs he would have succeeded in doing so as a trained officer.The AG further directed the police to take a charge statement from the suspect and also endeavour to get the post mortem report from the pathologist.The report indicates that on November 10, 2005, Constable Kwakye, stationed at the Dansoman Police Station, was attached to the Patrol Team at the Regional Police Headquarters in Accra.He was detailed with others to assist some officers of the Amasaman Police Station to arrest some suspects involved in a case of stealing and causing harm at Abehenease near Amasaman.When they got to the area, they saw many young men, who fled on seeing the police approach the area.The policemen pursued the young men including Gabienu, the deceased, who ran towards a near by bush wielding a sharp machete and a catapult.In the course of the chase, Constable Kwakye fired three warning shots but the deceased failed to stop till he fired a fourth one which hit the mid section of the deceased killing him instantly.Constable Kwakye in his first statement to the police after firing three warning shots, the deceased turned and advanced towards him with a raised machete to slash his head so he aimed at his legs but unfortunately he missed the target.An inspector among the group told investigators that he heard four shots during the operation.Investigations later revealed that the deceased was shot from behind as he was running and not the front as Constable Kwakye said.Source: Daily Graphic
