Former Attorney‑General, Godfred Yeboah Dame, has criticised current Attorney‑General Dr. Dominic Ayine, asserting that no funds have been recovered in the ongoing Unibank case despite Dr Ayine’s recent claims.
In a Facebook post on Tuesday, July 29, Mr Dame argued that Dr Ayine used his power of nolle prosequi, a legal notice to discontinue prosecution and to shield his former clients from criminal charges.
“All the assets of the Duffuors, Unibank, and related companies…had already been identified by the Receivers of Unibank appointed by the Bank of Ghana,” Mr Dame wrote.
He added that Dr Ayine has not recovered a single cedi in the case and should clarify if any new assets were discovered this year by him or his team.
"Dr. Ayine should indicate to the public when either himself or his team this year discovered any new assets owned by the Duffuors.
"The record will reflect the fact that, to date, Dr. Ayine has not recovered a single Cedi in the Unibank matter," he said.
Mr Dame explained that the Attorney General is proposing to offset liabilities using assets already known to the Receiver, a practice not governed by existing law but enabled solely by the nolle prosequi declaration.
“Dr. Ayine thus cannot lay claim to recovering any more assets than what the Receiver already has. He also cannot claim to have recovered for the Republic any money from the accused persons this year,” he added.
