An Accra High Court has dismissed the case brought against the Electoral Commission by Mr. Dan Lartey.
The Leader of the Great Consolidated Popular Party had asked the court to overturn the EC’s decision to disqualify him from contesting the elections as a presidential candidate.
He argued the EC had no right to disqualify him as, such a decision could be taken on by the Attorney-General’s office.
But the court upheld the EC’s decision that Mr. Lartey failed to submit completed nomination forms in time.
It awarded cost of GH¢1, 500 against the plaintiff.
After the verdict, Mr. Lartey declined interviews with the media.
But his lawyer, B. B. Quaye spoke to the media agreeing with the Judge's decision.
He said in his opinion, his client should not have brought the case against the EC in the first place.
It is unclear what next Mr. Lartey will do.
For now it seems he is effectively out of the December 7 2008 presidential elections, special voting having gotten underway.
