Former Chair of the Commission on Human Rights and Administrative Justice (CHRAJ), Justice Francis Emile Short says Ghana must enact certain laws to effectively deal with the immerse corruption happening the country.
Speaking on Joy FM’s Super Morning Show, Justice Short said although the 1992 Constitution tackles some forms of corrupt activities, it does not have a clearly stated regulations guiding unexplained wealth.
This, according to him, makes it difficult to prosecute public officials, who within a short period of time after assuming office, accumulate assets at the expense of the public purse.
“Establishing law to deal with unexplained wealth will be a step in the right direction,” he told Joy FM’s Winston Amoah, Wednesday.
The former CHRAJ boss observed that until Ghana emulates countries like the United Kingdom, unexplained wealth accrued by individuals, particularly, persons in authority cannot be criminalised.
“As the law stands at the moment if your neighbour acquires unexplained wealth within a short time in office and you report to the police; it is not a criminal offence.
“The enforcement agency would have to proceed under the power that CHRAJ has or EOCO has to be able to conduct an investigation, otherwise, there is nothing that you can do about the unexplained wealth the person has,” he alluded.
Speaking on the same beat, the Assistant Public Relations Officer (PRO) of Ghana Audit Service, Bernard Conduah said public officials must not only declare their assets but their liabilities as well.
According to him, acquiring assets is not the only form a public official can expend the unexplained wealth accrued, but being able to clear the 'unseen' liabilities must also be of interest.
