The Accra Circuit Circuit has dismissed a filed application for Fantasy Dome to be re-opened by the facility's management.
The Counsel for Mr Edmond Dapaah, the Facility Manager and fourth accused person in the Christ Embassy Pneumatic Night case, argued that the Dome, which serves as a recording studio and a source of livelihoods for many, has been closed since April 30.
Lord Delvin Essandoh, after filing the motion on July 1, therefore, prayed to the court to order that the facility be reopened.
But Ellen Offei Aryeh, presiding over Friday’s hearing, July 16, stated that the court required the presence of the Inspector General of Police in such an application since it locked up the facility.
The ruling further stated that the court has not been informed of who ordered the facility's closure, hence the decision to struck out the application.
Meanwhile, the court has ordered the prosecution led by Chief Inspector Simon Appiorsornu to file their witness statements on or before August 18 and ensure service on the accused persons three clear days before the next sitting.
The court has also adjourned its next hearing to August 27, 2021, for Case Management Conference.
Some four persons connected with the Christ Embassy Pneumatic Night concert held on May 2, which was said to have been held in violation of Covid-19 protocols, were arrested by the Police.
The event held by the youth wing of the Christ Embassy Church received serious backlash from many social media users who condemned the gross disregard for Covid-19 protocols at the event.
Following that, the Ghana Medical Association called for the arrest and prosecution of the church's leadership.
The first three accused persons are Alex Asomani, Wilson Delali Agyemang and Kumi Nutifafa, members of the Christ Embassy Church.
The charges levelled against them are conspiracy to commit a crime, namely, failing to comply with restrictions imposed; Contrary to section 23(1) of the criminal offences Act, 1960(Act29) and section 6 of the imposition of Restrictions Act, 2020(Act1012) and regulation 1 of E. I. 135/2021, that is for all three church members as well as abetment of crime namely failing to comply with restrictions imposed; contrary to section 20(1) of the criminal offences Act, 2020(Act 1012) and regulation 1 of E. I. 135/2021 for the fourth accused persons.
Also in the dock was Mr Edmond Dapaah, the Facility Manager at the Fantasy Dome of the International Trade Fair Centre, who has been charged for abetment of crime.
They have all pleaded not guilty to all the charges. Accordingly, the accused persons will rely on their previous bail granted them in the sum of GH¢80,000 each with two sureties.
