One of the lawyers representing the embattled MP for Bawku Central Adamu Daramani has expressed his displeasure over Monday’s Appeal Court decision against their client.
Mr. Egbert Failbil says his client was not served notice of the hearing.
He said the move by the court was improper and against the rules of natural justice.
The Appeals Court dismissed Mr. Dramani’s application for a stay of proceedings of an application by Sumaila Bielbiel to get the court enforce a default judgement he obtained against the MP after challenging his nationality as a Ghanaian.
The High Court disqualified Dramani from holding himself as a Member of Parliament (MP).
Speaking on the Super Morning Show on Tuesday, Mr Faibile faulted Dr Raymond Atuguba, lawyer for the cattle dealer, Sumaila Bielbiel, for proceeding to have the case heard by the Appeals Court although the court had earlier indicated the matter would be heard in October.
Mr Faibile said he had reliable information that “the Court of Appeal told him [Dr Atuguba], the same panel that told us the previous day that we should come back in October,…that you cannot do this.”
“We have been in our chambers, we have not heard anything until the information came to us that that application came on at the Court of Appeal at the instance of Dr Atuguba and it has been struck out,” he said.
Responding to the issue however, Dr Atuguba said he would remain tight-lipped on the matter while it is still before court, but insisted the decision by the court followed due process.
Meanwhile Mr Adamu Dramani is still facing criminal charges preferred against him by the Bureau of National Investigations (BNI).
Mr Dramani has been filing his defense over nine counts including forgery of passport or travel certificate, perjury and false declaration for office.
