The High Court in Sefwi Wiawso presided over by Mr. Justice K.B. Aning, on Wednesday December 16, 2009 dismissed an application for interim injunction to restrain the Western Regional Minister and all District Chief Executives in the Region from interfering with contracts awarded to caterers appointed by the NPP under the School Feeding Program.
Lawyer Kwadwo Owusu Afriyie alias Sir John, who is contesting the position of General Secretary of the New Patriotic Party filed the case at Sefwi Wiawso against the Western Regional Minister and all District Chief Executives in the Region. He similarly lost a another case in Kumasi in which he sued the Ashanti Regional Minister, his Deputy and all the 39 District Chief Executives in the Ashanti Region over the termination of contracts awarded by the NPP under the School Feeding Program.
In his ruling, his Lordship Justice K.B. Aning held that the Plaintiffs' application for Interlocutory Injunction should have been filed in the High Court at Sekondi and that it was an act of bad faith for the Plaintiffs to bypass the Sekondi High Court and come to Sefwi Wiawso to sue the Regional Minister and the Chief Executives.
His Lordship Justice K. B. Aning upheld the Attorney General's objection to the jurisdiction of the Sefwi Wiawso High Court. According to the Judge, of the 3 High Courts in the Western Region - Sekondi, Tarkwa and Sefwi Wiawso, the High Court at Sekondi is the best forum for the Plaintiffs to initiate their action.
He, therefore, directed the Registrar in his ruling, to forward the entire docket on the matter to the CJ for further directives with a view to having the case transferred to the Sekondi High Court for hearing.
Lawyer Kwadwo Owusu Afriyie, counsel for the plaintiffs, was not present in Court.
