There was a drama at the premises of Cocoa Affairs Court today, after the Circuit Court 5 acquitted and discharged Alhaji Mansuru Mako, a private security agent who was accused of defiling a 12 year-old girl. They were both staying in the same house at Nima in Accra.
About 30 minutes after the court ruling, some family members and friends of Alhaji Mako and those from the victim's side, who were apparently not happy about the court’s ruling, clashed at the premises of the court throwing stones and objects at each other. A lady sustained head injuries.
Alhaji Mansuru Mako was arraigned before the Accra Circuit Court 5 presided over by Mrs Georgina Mensa-Datsa, for allegedly having sexual intercourse with the victim and was kept in police custody for six months.
On Monday, the court ruled that the age of the victim was doubtful as no evidence was provided by the prosecution led by ASP Sarah Ekua Acquah on the exact age of the girl. It was established that the victim could be more than 16 years and not 12 years as presented to the court.
The court also established that the prosecution witnesses presented it with conflicting evidence. During cross examination, one of the witnesses, who claimed the victim confided in her, said the victim told her that Alhaji Mako only fondled her but did not have sex with her.
After the ruling, a very elated Alhaji Mako told the media that the ruling was fair and believed that the whole case was a set up. He expressed his gratitude to his wife who was one of his witnesses in the case for standing by him.
Meanwhile, the father of the victim, Mustapha Mohammed disclosed to Asempa News that he will definitely file for an appeal on the court’s ruling. Members of human rights NGO, PSO Foundation, were in court to support the victim all looked dejected after the ruling.
