The National Democratic Party (NDP) says it is heading back to court to enforce its rights which it believes the Electoral Commission (EC) has blatantly violated leading the eventual disqualification of the party's Presidential Candidate.
In a statement released hours after an Accra High Court presided over by Justice Goerge Koomson struck out the suit on procedural grounds, the party's General Secretary, Mohammed Frimpong said although they disagreed with the ruling they are gratified that the judge in his closing statement said, "the door is still open."
Justice Koomson explained that it is against procedures of the court to file a joint application praying for the EC's decision to be reviewed and at the same time demand for the enforcement of the Presidential candidate's fundamental human right to vote and be voted for.
He described the suit as incompetent and fined the applicants GHC10,000.
However, Mr Frimpong assured the parties supporters that they will continue to fight to ensure that persons in public offices respect Ghana's Constitution.
