An Accra High Court has adjourned the case in which the flagbearer of the All People's Congress is challenging his disqualification to contest this year’s election.
The case was adjourned to Tuesday, November 1 after both parties failed to file a statement of case last Friday as directed by the court.
Presiding judge Barbara Tetteh-Charway after ordering abridgment of time for hearing the case, directed the parties to file their statement of case by Friday.
This was to allow oral arguments from the plaintiff Hassan Ayariga and the respondent, the Electoral Commission to be heard on Monday.
But on Monday, October 31, the lawyer for the Electoral Commission Thaddeus Sory said his inability to file the statement on Friday was because the Commission has been saddled with a litany of court cases.
Hassan Ayariga's counsel, Maxwell Logan said he has not been well but his clerk was filing at the time the court was in session, according to Joy News' Ackah Blay.
Both counsel apologised for not filing the statement after which Lawyer Logan asked that "the court adjourns and fixes a date for the ruling by relying on what we will be submitting."
Presiding judge Barbara Tetteh-Charway said she would like to first have a look at both statements of case and if she has questions she will ask the lawyers to address the court.
Speaking to Ackah Blay, Hassan Ayariga expressed his confidence in the court to deliver justice.
"I think we have a better case than the PPP...in our case we have properly filled our documents...I think that the court will deliver justice as a political party all we are seeking for is to be part of an election and have a presidential candidate," he indicated.
Some supporters of the APC who stormed the court in solidarity had inscriptions such as "NDC and NPP are not above the law."
