JOY BUSINESS can confirm the immediate past Acting Chief Executive of the now Export Development and Agric Investment Fund, EDAIF, Agyabeng Antwi-Agyei is heading for court over his dismissal. He along with the Fund’s Directors for Fianance and Audit were some days ago dismissed by the Board of Directors for gross misconduct and causing financial loss.
But Mr. Antwi-Agyei wants to sue the Fund for what he deems wrongful dismissal. This was indicated in a notice attached to his response letter to the Board Chairman dated 26th March and copied to the Secretary to the Public Services Commission, Board Members of the Fund and the Trade and Industry Minister.
In the communication cited by JOY BUSINESS, Mr. Antwi Agyei’s lawyers noted that the reasons given for his dismissal are “unmeritorious and consequently unjust”. According to the lawyers, Mr. Antwi-Agyei’s dismissal by the board is unlawful since according to the act that established the Fund, the power to appoint and by implication dismiss the Chief Executive is vested solely in the President.
The lawyers are therefore seeking damages and compensations for wrongful dismissal and legal costs.
Given EDAIF is an unincorporated agency of the state,the intended legal action ewhich the lawyers say is to protect Mr. Antwi Agyei’s rights is being taken against the Attorney General. Per the laws, the Attorney General has one month from the date of issue of the notice to fulfil the reliefs or have the issue ruled by courts.
