Following the sentencing of some pro-government communicators, a legal practitioner Samson Lardy Anyenini has called for a serious public discussion on contempt.
Samson Anyenni suggested that the recording of the contemptuous comments by the communicators who have been jailed four months could form the basis of the discussion
Education Minister Prof. Jane Naana Opoku Agyemang and her deputy Samuel Ablakwa, Gender and Social Protection Nana Oye Lithur and Tourism minister have all signed a petition calling for presidential pardon for Alistair Nelson, Godwin Ako Gunn and Salifu Maase.
Salifu Maase who hosts Montie FM’s political programmes urged the two others on when they threatened to kill judges and rape the Chief Justice after they handed a controversial ruling in favour of some opposition politicians.
With ministers and traditional rulers backing the calls for mercy, the NDC lawyer for the convicts Nana Ato Dadzie has also described contempt as an old unruly animal that should be expunged from the law books.
Samson told myjoyonline.com, he believes that the time is right for a more wholistic discussion on the offence of contempt and defamation.
He wants the tapes to be replayed on radio stations so that the cringe-worthy statements can disabuse the minds of the public.
Samson also believes that it will also disable those criticizing the judges for handing down “harsh prison sentences” to the three.
Portions of the judgment of the Supreme Court that jailed the three for criminal contempt observed the two radio panelists and the host were "willful, insulting, cruel, totally reckless and insensitive, callous" when they verbally attacked the judges.
The presiding judge Sophia Akuffo while reading the sentence expressed disappointment in the Attorney-General Marietta Brew Appiah-Oppong for failing to prosecute Alistair Nelson, Godwin Ako Gunn and Salifu Maase.
The Supreme Court judge has been criticised for being both prosecutor and judge in her own cause.
But Samson has drawn attention to the fact that if the Attorney-General had prosecuted the three, they could have been jailed for up to 10 years.
He said Ghanaians are being misinformed by people “who should know better”.
