The Supreme Court has adjourned hearing of a case in which two deputy ministers are challenging the right of the former Tourism Minister, Jake Obetsebi Lamptey to purchase the state bungalow he occupied before leaving office in 2008. Samuel Okudzeto Ablakwa, Deputy Minister of Information and Dr. Omane Boamah Deputy Sports Minister have accused the former minister of abusing his office in his attempt to purchase the No 2 Mungo Street in the Ridge residential area he was occupying at the time. They claim the action by Jake Obetsebi Lamptey contravened Articles 20 (5) and 20 (6) and amounted to a gross abuse of the discretionary powers of a public officer. Jake Obetsebi Lamptey had early on challenged the mandate of the court to hear the case arguing the plaintiff ought to have gone to the Commission of Human Rights and Administrative Justice if the thought he (Lamptey) was abusing his office. The court presided over by Justice William Atuguba in a unanimous decision held the Supreme Court had jurisdiction to hear the case which bothered on constitutionality and adjourned hearing. On Wednesday, the court was to pronounce judgement on the actual case brought before it by the plaintiff but adjourned to May 23, 2012. Joy News’ Anny Osubutey who was present at the court reported the presiding judge as saying that one of the judges was sick and could not sit on the case. The judges include Ms Justice Sophia Akuffo, Mr Justice S. A. Brobbey, Mrs Justice Sophia Adinyira, Mrs Justice Rose Owusu, Mr Justice Jones Dotse, Mr Justice Baffoe Bonnie, Mr Justice B. T. Aryeetey and Mrs Justice Vida Akoto Bamfo. According to the Osabutey both the plaintiff and the defendant were present at the court.
