Counsel for the governing National Democratic Congress in the ongoing Presidential Election Petition has filed a motion seeking to cross examine witnesses whose testimonies have come by affidavits.
The Supreme Court as part of its directive ordered the parties involved in the election petition case to come by affidavits testimony in order to facilitate a speedy trial.
By affidavits testimony, witnesses will, in writing address all questions that they would ordinarily have answered had they been dragged to the witness box.
The Court however indicated it will grant a special dispensation to key witnesses to appear in person and if necessary, also grant an application for other witnesses who have sworn affidavits to appear in person.
The third respondent Tsatsu Tsikata has taken advantage of this caveat and has applied to cross examine some of the witnesses for the petitioners who have sworn affidavits for the petitioners.
A member of the legal team of the petitioners, Gloria Akufo has stated emphatically that they are opposed to the motion filed by the third respondent.
She said in a post trial interview on Monday they will contest the application.
The Supreme Court is expected to hear arguments on the application and make a ruling before the substantive hearing of the Election Petition case continues on Tuesday.
