A high court in Accra on Thursday dismissed a case against the election of a new president by the Ghana Bar Association (GBA).Three lawyers, Nana Ato Dadzie, Chris Ackumey, and James Abeaduka filed for an injunction to be placed on the election of the new president.They described as illegal the forced resignation of former President Nii Osah Mills and requested the court to reinstate him.Nii Osah Mills had publicly commented on the case involving the incarcerated former GNPC boss Tsatsu Tsikata, comments which the National Executive Council (NEC) of the bar considered prejudicial to an impending case at the appeals court.The NEC on the eve of the Bar Association’s annual general meeting pushed for the resignation of Osah Mills, an action which triggered marked differences within the association, with the three seeking legal action for redress.The court however dismissed the case saying it was unconstitutional for the lawyers to institute legal action when their rights had not been trampled upon.A GH¢ 3,000 cost was subsequently slapped on the plaintiffs.Whilst agreeing with the cost awarded the defendants, Nana Ato Dadzie one of the plaintiffs insists the judge erred in law.“The judge was a little sweepy in the judgement,” he said, adding the judge overlooked minute details that were inherent in the suit.He told Joy News they will file an appeal.But a member of the legal committee of the GBA Ken Brookman Emissah says the appeal has no merit.Story by Nathan Gadugah
