Attorney General Dr Dominic Ayine says suggestions by his predecessor, Godfred Yeboah Dame, that President Mahama suspend consultations to potentially remove the Chief Justice from office are in variance with the law, which states that one cannot enjoin the discharge of a constitutional duty.
The former Attorney General, speaking to journalists at the last adjourned date of the suit filed against the processes for the removal of the Chief Justice, stated that he expects President Mahama to halt the consultation process he's initiated with the Council of State by virtue of processes filed at the Supreme Court.
But responding to questions by JoyNews' Latif Iddrisu at the Supreme Court Wednesday morning following another adjournment of the injunction applications, Dr Ayine said the consultation process initiated by the president constitutes the performance of a constitutional duty which cannot be stopped.
In a brief ruling, Chairperson of the panel, Her Ladyship Henrietta Mensah Bonsu, stated that " for unavoidable reasons we would have to adjourn to May 6."
The five-member panel is made up of His Lordship Justice Ernest Yao Gaewu, His Lordship Justice Richard Adjei-Frimpong, Her Ladyship Justice Prof. Henrietta Mensa-Bonsu, His Lordship Justice Samuel Kwame Adibu-Asiedu, and His Lordship Justice Yaw Darko Asare.
The absence of one of the Justices on the panel is believed to be the reason why the case has been adjourned.
