The High Court (Criminal Division) has thrown out an application filed by former Finance Minister Kenneth Ofori-Atta challenging the legality of a warrant issued for his arrest by the Office of the Special Prosecutor (OSP).
The court, presided over by Justice Lydia Osei Marfo, delivered its ruling on Wednesday, July 30, concluding that the application lacked merit.
Mr Ofori-Atta had argued that the OSP acted unlawfully in securing the warrant, insisting that due process was not followed.
He further called on the court to set aside all related proceedings, including an Interpol Red Notice that was issued against him.
His legal team described the actions of the OSP as “procedurally flawed” and “in breach of his constitutional rights”.
In response, lawyers for the Special Prosecutor maintained that the warrant was properly obtained and executed within the remit of the law.
“There is no evidence before this court that the OSP acted outside its mandate,” the prosecution argued, urging the court to dismiss the application.
Delivering her decision, Justice Osei Marfo ruled that the court found no basis to interfere with the actions of the OSP.
“The application is hereby dismissed in its entirety,” she said, adding that the arrest warrant and accompanying Red Notice remain valid and enforceable.
