A Commercial Court in Accra has thrown out an injunction application seeking to prevent government from going ahead with the digital migration process.
Presiding Judge George Koomson will provide reasons for his ruling on March 16, Joy News' Kwakye Afreh Nuamah reported.
Star Communication Network Technology Company Limited of China sued the Ministry of Communications over the abrogation of an April 11, 2012 contract for the supply and installation of a reliable energy-efficient and cost-effective Digital Terrestrial Television (DTT) Network Solution.
But the MoC justified the abrogation of the contract, accusing the plaintiff of making false representations.
The Ministry also said Star Communications failed to meet its part of a contractual arrangement to pre-finance the project and be reimbursed within a 10-year period.
In their affidavit in opposition to the plaintiff’s motion for interlocutory injunction, the ministry said it acted within the laws of the country.
The court agreed with the position of the Respondent but will give a comprehensive ruling later in the month.
With the injunction out of the way, the Communications Ministry says it will fast track activities to meet the June 2015 deadline to conclude the digital transfer.
The Deputy Communications Minister Ato Sarpong told Afreh Nuamah they will soon receive bids for the process to begin
