The Court of Appeal Wednesday granted a stay of execution of the High Court decision disqualifying the Member of Parliament for Bawku Central, Adamu Dramani from holding himself as an MP.
The three man panel headed by Justice Yaw Appau also granted a stay of proceedings application by counsel for Dramani in his trial for allegedly holding dual citizenship and therefore unfit to be a member of parliament in Ghana.
The Court of Appeal had earlier dismissed the two applications on grounds that the MP had failed to respond to court processes and was also not in court when the case was called.
It turned out that a court bailiff had misled the court when he professed service of processes on counsel for Mr. Adamu when he had indeed not done so. The court, upon discovering the fraud, decided to revisit the matter.
The other members of the Court of Appeal panel are Justices Aduamoah and P.K. Gyaesaayo.
Wednesday’s ruling paves the way for the hearing of two appeals by counsel for Dramani. The appeals are in respect of the trial high court’s ruling refusing to set aside its judgment and an application for the execution of the default judgment it awarded against the MP.
The Court of Appeal held that the appeal applications raise serious questions of law and should be contested.
Adamu Dramani’s qualification as MP was challenged by a constituent of Bawku Central, Sumaila Bielbiel, who contends that he has evidence the MP has Ghanaian and UK citizenship and should therefore be disqualified.
