An Accra High Court has thrown out a suit filed by suspended Chairman of the New Patriotic Party seeking to stop the party from discussing matters relating to the chairmanship position in Tomorrow's Special Delegates Conference.

Paul Afoko, suspecting he could be removed by the highest decision making body of the party at the Delegates Conference sought refuge in the court  and filed an ex-parte motion seeking to restrain the party from taking that decision.

However lawyers of the NPP, including Godfred Dame, Prof Mike Ocquaye, Nana Obiri Boahene and Dr Adusei Poku got wind of his action and rushed to the court to defend the party.

They told the court ,Afoko's reason for seeking an injunction was baseless and highly speculative.

Joy News' Kwakye Afreh-Nuamah who was present in court, reported the defendants as saying the party has no agenda to remove him tomorrow and if at all they did, they would follow a number of procedures before doing do.

They further stated even if they did, Afoko will still have his day in court, to challenge that decision. 

But Afoko's lead lawyer Osafo Buabeng told the sitting judge Anthony Yeboah, if the party had no plans to remove his client, why were they in a haste to challenge the injunction application.

He said his client had intercepted text messages from high ranking members of the party suggesting the chairman will be removed. He prayed the court to restrain the party's delegates from taking any such decision.

The sitting judge Anthony Yeboah however ruled that  the plaintiff ought to prove that his removal may cause irreparable damage to him as a person before his suit will be considered.

He agreed with the defendants that even if the suspended chairman  were to be removed during tomorrow's conference he will still have the opportunity to challenge that decision in court.

He therefore threw out the case.

Deputy General Secretary of the party Nana Obiri Boahene said the ruling is victory for the party and accused the suspended chairman of trying to embarass the party.
