A lawyer who is seeking an investigation into the role of a Member of Parliament to “pervert the 1992 constitution” in January 2009 says his action is in the interest of the public. Lawyer Sam Pee Yalley has petitioned the Commission on Human Rights and Administrative Justice (CHRAJ) to investigate the MP for Abuakwa South, Samuel Atta-Akyea for judicial corruption. “Atta Akyea has corrupted the judicial system of the Republic of Ghana and against public interest,” he said. He said the MP, who is also a lawyer, sought a High Court order in January 2009 to restrain the Electoral Commission from declaring the results of a run-off election in Tain in the Brong Ahafo Region. Mr Yalley, a former minister under the Rawlings administration, told Joy News on Thursday he has tape evidence in which the MP spoke of a conspiracy to get a judge off the case. He is also seeking in his 15-point complaint that CHRAJ extends its investigations to cover other 'conspirators' whose voices are heard on the tape. “The judicial process filed against the Electoral Commission of the Republic of Ghana prohibiting the conduct of elections at the Tain constituency amounted to an abuse of the electoral process and also an attack on the fundamental human rights of the Tain constituents, particularly and Ghanaians in general to freely exercise their franchise in a national election,” he stated in his complaint to the commission. “There should be a declaration that the said Atta Akyea had inappropriately used his family relations with the Chief Justice in his attempt to pervert the 1992 Constitution of the Republic of Ghana for private and political advantage,” he said. Meanwhile Joy News checks at CHRAJ reveals the complaint filed last Tuesday 31 May, 2011 is being scrutinized by the Legal and Investigations Unit to establish whether the complaints fall within the mandate of the Commission.
