Lawyers of jailed NDC MP for Keta, Dan Abodakpi have filed a motion in court seeking to use an allegation of judicial interference against one of the judges to secure bail for him.
The lawyers are accusing Justice Henrietta Abban, one of the panellists on the case for interfering in the delivery of justice which led to the ruling against their client leading to his subsequent incarceration.
The lawyers are suggesting that based on that, the ruling against their client must be dismissed.
The lawyers led by Tony Lithur have accused Justice Abban of influencing the ten year jail term imposed on their client, Mr. Abodakpi.
Mr. Abodakpi is serving a ten year jail sentence for causing financial loss to the state.
The lawyers are arguing that based on the conduct of Justice Abban, their client should be granted bail pending the appeal against his sentence.
On Tuesday, October 9, 2007, the Lawyers attempted to introduce a motion in court that calls into question the judge’s conduct to strengthen the grounds for their call for bail for Mr. Abodakpi.
The Panel however, refused to admit the motion on the grounds of administrative inaccuracies.
Meanwhile, Justice Abban has excused herself from the bench to make way for a mini trial to clear her name. Justice Marsu-Sao has been appointed to replace her.
The case has been adjourned to Thursday October 11, 2007 to enable the court’s registry to rectify the error.
