The Appeals Committee of the Ghana Football Association has dismissed the appeal brought by King Faisal against the decision of the Disciplinary Committee which dismissed their petition against Aduana Stars for the enforcement of non payment of cost.
King Faisal had appealed against the Disciplinary Committee (DC) ruling dated August 20, 2014 which dismissed their petition to seek the enforcement of Articles 34(1)(L) and 39(8)(b) of the General Regulations of the Ghana Football Association.
The Appeals Committee considered the submissions of the parties and the 7 grounds of appeal filed by King Faisal. The Appeal Committee noted that King Faisal failed to make submissions on grounds 1, 2, and 4 of their appeal.
"Accordingly, we consider them having been abandoned by the appellants and consequently, we refrain from making any pronouncements on same" the AC ruling stated.
On grounds 3, 5, 6 and 7 it was the view of the Appeal Committee that the Disciplinary Committee did not err in their decision and accordingly dismissed the Appeal on those four grounds.
"In conclusion, it is the decision of the AC that the appeal lacks merit and same is dismissed,” the ruling stated.
No cost was awarded against King Faisal.
According to the appellant - King Faisal, Aduana Stars failed or refused to pay cost of GH¢5,000.00 imposed against them by the DC of the GFA within 14 days as stipulated under Article 39(8) of the General Regulations and consequently, ought to be punished to forfeit all matches played during the period of default.
Aduana Stars in their response argued that after they received the decision which imposed the cost on them, they duly filed an Appeal and a Stay of Execution of the said decision which were still pending and, therefore, could not be blamed for any default whilst the Stay of Execution was yet to be determined by the DC.
